KENNEWICK, Wash. (AP) - A mistrial has been declared in the manslaughter case against a nanny accused of fatally injuring a 1-year-old Richland boy.
A Benton County jury deliberated into a fourth day Friday before telling Judge Vic VanderSchoor they couldn't reach a unanimous decision.
The case against Kelli Jacobsen went to the jury Tuesday after two weeks of testimony.
Prosecutors say 28-year-old was responsible for the death of Ryder Morrison in June 2011. She said he had fallen and hit the back of his head. The autopsy found the boy died of bleeding normally caused by whiplash, not a fall.
The defense lawyer says the evidence is not conclusive and the boy also had problems while he was with his mother.
A hearing was set for next week to see if the prosecutor plans to retry Jacobsen.
