SUBWAY says "Footlong" was just a figure of speech

After an Aussie man dared to put a tape measure to Subway's "Footlong" sandwiches and found them lacking, news crews and customers across the globe have done the same and found the footlong to be closer to 11 or 11 and a half inches. Subway now says that "footlong" was never supposed to be a measurement but a trademark.
Sounds a little fishy to me, but even McDonald's "Quarter Pounders" are only 1/4 pound prior to being cooked. And would the extra inch/inch and a half of sandwich really make a difference other than boost the price point beyond $5 bucks? Subway should instruct all stores to stick a piece of lettuce out the end of the sandwich so that it passes the tape-test and keeps the lawyers at bay.
