The King County Prosecutor will not file felony charges against a dangerous sex offender who fled Canada and was arrested for an alleged sexual assault in West Seattle in October.

Seattle police arrested Michael Sean Stanley on Oct. 22 after officers responded to a report of a man yelling in an alley in the early morning hours. Following his arrest, Stanley was accused of sexually assaulting a 16-year-old boy who went into the alley with him.

“The case is being declined for criminal prosecution because there is insufficient evidence to prove that a forcible sexual assault had occurred,” the prosecutor’s office said in a brief statement Friday.

Stanley pleaded guilty in January to harassment and resisting arrest charges stemming from the arrest and was sentenced to 60 days in jail.

Stanley set off a firestorm when the convicted sex offender fled Canada after cutting off his GPS monitoring device and crossing into Washington state at the U.S.-Canada border.

Canadian officials refused to seek extradition.

Stanley is scheduled to be released from jail Monday, and will be required to continue reporting to officials as a sex offender.
