A closer look at two new charges filed against the ‘Barefoot Bandit’ reveals a problem.

The problem, according to the Associated Press, is that Colton Harris-Moore has already pleaded guilty to one of the charges, the theft of an airplane he flew from Arlington to Orcas Island in February 2010. He pleaded guilty in December 2011 as part of a consolidated prosecution involving three counties.

Skagit County did not participate in the plea agreement and last week, Skagit County Prosecutor Jim Weyrich charged Harris-Moore with burglary and theft, crimes related to the same airplane theft. The theft charge would appear to violate his right against being prosecuted twice for the same crime.

The Skagit County Prosecutor’s office did not immediately return a call and email seeking comment.

Harris-Moore, 21, is serving a seven year prison sentence. His notorious, two-year crime spree ended after he crash-landed a stolen airplane in the Bahamas.
