Arrested for not paying a tip

You're with a large group at a bar & grill. The B&G automatically adds an 18% gratuity to the bills of parties of six or more. And then you discover the service is horrible. The owner of the eatery even admitted the service was unusually slow that night.

Should you be allowed to not pay the "gratuity"?

This young college-age couple said that, given the lousy service, there is no way they should be forced to pay the mandatory tip.

AND THEY GOT ARRESTED FOR IT!

    I have been stung by this before as well. However, Dori, this is a miniature example of your unregulated free market.

    Obviously, this employee knew a tip was coming, regardless the level of service provided.

    These businesses have no requirement to post in a clear manner that 18% will be added to the check regardless of the level of service. If I were to walk into a restaurant and see a sign like that, I would walk right back out. If these businesses were regulated, maybe the lack of business would force them to change their ways.

    That being said, that is all of a tip they would get and I would do my best not to return.

    Why was the service so bad? After watching the video it appears that the restaurant was way under staffed. Managements fault. I would probably pay the whole bill, then write a letter to the owner explaining the situation, if they made it right, all is fine, if not next time I am going elsewhere.

    However, if the wait staff is rude, etc, no tip. Take me to jail.

    Every restaurant I go into that requires an 18% gratuity for large groups says so on the menu otherwise the restaurant has no legs to stand on when the case eventually goes to court.

    Unregulated free markets doesn't mean you can add whatever charges to somebody's bill with no dispute. I can't see the video right now, but if there was no sign or anything written down anywhere in the restaurant then the restaurant is in big trouble. Also I would hope the officer would ask to see this as well before arresting the couple otherwise the officer could be in trouble too.

    When a restaurant does this....
    they have to print that a gratuity is included on the menu. That gives the diner the opportunity to decide on staying or leaving before they order their food. Ordering food is an acceptance of this term of the meal.

    I think this is a better example of how people don't work hard if they don't have the proper incentive. The wait staff knew they were getting 18% whether they gave good service or not. They probably gave much better service to tables where the tip wasn't guaranteed. This is actually a miniature example of why government handouts lead to a lazy, unmotivated populace.

    It is real simple for me
    if they treat me right I tip them if they don't then I don't. If they try to add the automatic tip I just deduct it when I pay. If they don't like it then they can call the cops. The complaining to follow will be loud and long, so much for ambiance.

    Seems perfectly logical to get arrested for not paying a tip, I mean if they're proposing that you get jail time for not having health insurance then this should be a felony. Where can I get a brown shirt and night stick?
