The union for King County sheriff's deputies will not help Paul Schene get his job back.
Sheriff's spokesman John Urquhart told The Seattle Times that Schene can't go to arbitration without the support of the King County Police Officers Guild.
Schene still has the option of filing a civil lawsuit to claim he was wrongfully terminated.
He was fired last year for using excessive force in beating a 15-year-old girl who kicked a shoe at him in a SeaTac holding cell.
Schene was tried twice on assault charges and both trials ended when the juries could not agree on a verdict.
