With the state about to execute its first prisoner in nine years, many are looking at how the death penalty is administered in Washington.

One case keeps coming up, the Christopher Monfort case.

Even though he's accused of killing Seattle Police Officer Timothy Brenton, people are asking if it is appropriate to execute him now that he's permanently disabled.

"Some will look at him in a wheel chair with one eye gone and say oh well it would be cruel to kill him, but he showed absolutely no mercy whatsoever for Officer Brenton when he walked up he killed him at point blank range and then tried to kill the training officer with him," said State Attorney General Rob McKenna.

McKenna says whenever the death penalty is used in Washington, there is no doubt that the person is guilty.
