Marysville cop’s attorney wants dismissal of manslaughter charge

A judge will be asked to dismiss the criminal case against a Marysville Police officer whose daughter was accidentally shot and killed when he left a gun in his car.

Officer Derek Carlile left a loaded gun in his car when he got out to speak with friends. His four children were in the car.

Prosecutors say the 31-year-old officer’s 3-year-old son grabbed a .38-caliber revolver from a cup holder bin next to the driver’s seat of the family van and fatally shot his sister, Jenna. The officer’s four young children were waiting in the van for Carlile and his wife who were outside the car speaking to friends on March 10.

Carlile is charged with second degree manslaughter, but The Herald reports his attorney will ask to have the case dismissed in September.

Carlile’s attorney says this was an accident, not a crime. Carlile is scheduled for trial in November.
