A newly obtained video capturing the man accused of shooting another man in a wheelchair at Seattle’s Pier 55 on July 31 has been released by prosecutors, according to KIRO 7.

The incident occurred just after 6 p.m. in front of a Starbucks on Pier 55, where Gregory William Timm, 32, allegedly shot Harold James Powell in his wheelchair.

Video released for Pier 55 shooting

Prosecutors stated that Timm accused Powell of “stolen valor,” claiming Powell, who is a regular street performer at the pier, didn’t serve in the military.

In the footage, Timm demanded Powell to show his military identification before he ripped a patch off his wheelchair. Powell then used his wheelchair to get closer to Timm and reached into his shirt to grab what appeared to be a firearm.

In response, Timm retrieved a handgun from his bag, pointed it at Powell, and fired one shot into his chest. The shooting occurred at Pier 55 during a time when several families, bystanders, and children were surrounding the area when the shot was fired. Witnesses of the shooting ran away from the scene, plugging their ears.

A video from a witness captured Timm standing with his hands up in the air for several minutes after the shooting. Police detained Timm at the scene minutes later.

Powell was transported to Harborview Medical Center in serious, but stable condition, as of this reporting.

The following day, Timm did not appear in court. A judge found probable cause for assault and robbery.

Timm’s attorney claimed the shooting was an act of self-defense; however, King County Prosecutor’s Office spokesperson Casey McNerthney said the argument would be difficult to uphold.

“A key in self-defense cases is who the first aggressor is,” McNerthney said. “If you provoke an attack upon yourself, you lose the right to claim self-defense.”

Timm was charged with first-degree assault and remains behind bars at the King County Jail on $750,000 bail.

The full video of the Pier 55 altercation can be seen here.

Previous charges for Timm

Court records indicated that in 2020, Timm was charged with aggravated assault in Florida for driving a van into a tent near a Trump supporter gathering. Timm was convicted of criminal mischief.
