A new trial starts Tuesday for a Marysville man accused of shooting and killing his 6-year-old daughter in 2008.
In 2009, prosecutors convinced a judge to sentence Richard Peters to more than 13 years in prison for manslaughter.
They said while drunk, he asked his little girl to retrieve a loaded gun from his bedroom.
Peters said his daughter’s death was an accident that his gun went off while he was changing the magazine.
A state court of appeals overturned the conviction on a technicality having to do with jury instructions.
