Don’t think for a second that Seattle’s lawsuit over President Trump’s order to cut federal funding to “sanctuary” cities that refuse to comply with federal law is just for show.

Former Washington State Attorney General Rob McKenna told KIRO Radio’s Dave Ross that the lawsuit has legs and even has a chance to succeed.

“Particularly given the current track record of the Trump administration,” McKenna said.

Seattle Mayor Ed Murray contends the city is not breaking federal law by refusing to ask people their immigration status.

It is a bit unconventional for a local jurisdiction to sue the federal government before something happens, McKenna said. What the City of Seattle seeks is a declaratory judgment to prevent the federal government from withholding funding, instead of waiting for funding to be withheld and then suing.

What is less clear: what happens to any local law enforcement that chooses to assist the federal government in finding and/or deporting illegal immigrants.
