Ross: Let anti-Obamacare states nix it, and let us keep it

In two weeks, in a Texas courtroom, lawyers representing 20 states will argue that Obamacare – or what remains of it – is unlawful, and that the court should therefore “enjoin its operation.”

That would mean no more requirement that insurance companies cover patients who are already sick.

The weird thing is that at the same time, Republican senators representing many of the very same states suing to kill Obamacare, are working on a bill to save the popular parts, such as requiring coverage for people who are already sick.

This is like uninstalling your seat belts and disabling your air bags, but then thinking ‘Maybe I should wear a crash helmet just in case.’

According to Kaiser Health News, the crash helmet bill in the Senate does require insurance companies to sell to everyone, but would also let them exclude any condition you already have. So if a cancer patient signs up, he might be covered for a broken leg, but not cancer.

Which tells me that for people with chronic conditions, this would be a good time to get well if at all possible.

What I think the judge should do is outlaw Obamacare, but only in the states that sued. Which is only fair. And it would also set up a real-world test: 20 states without Obamacare, 30 states with. We could finally figure out who’s right.
