The Seattle Police Department (SPD) said no charges will be filed against a woman whose unoccupied parked SUV rolled down a hill—hitting and killing a 12-year-old girl outside Washington Middle School on March 6.

Multiple students were walking on the sidewalk along 20th Place South, just before 1 p.m. that afternoon. The unoccupied SUV rolled backward toward them. It then rolled onto the sidewalk, striking three students. Seattle’s police and fire departments responded and rendered aid to the students. However, the 12-year-old girl was eventually pronounced dead.

SPD said after working with King County prosecutors and the Seattle City Attorney’s Office, and talking with witnesses and family members, it was unable to find any applicable criminal charges at this time.

A drug recognition expert was called to the scene and determined that the woman who owned the car was not impaired. She was, however, issued four parking citations.
